THE LIPTON HARD ICED TEA GROUNDHOG DAY FLYAWAY SWEEPSTAKES

NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE.

MUST BE 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY AND HAVE AN INTERNET CONNECTION.

ELIGIBILITY: The Groundhog Day Flyaway Sweepstakes (“Sweepstakes”) begins at 12:00:01 AM Eastern Time ("ET") on 01/01/2025 (“Start Date”) and ends at 11:59:59 PM ET on 02/02/2025 (“End Date”) (“Promotion Period”). Sweepstakes is open to legal US residents, including the District of Columbia who are 21 years of age or older at time of entry. This Sweepstakes is sponsored by High Falls Operating Co, LLC d/b/a The Sunrise Brewing Company (“Sponsor”). Employees of High Falls Operating Co, LLC (“Sponsor”), along with their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Released Parties”), any person affiliated with the alcoholic beverage industry, including but not limited to retailers of alcohol products, and their immediate family members (spouses, domestic partners, parents, children, and siblings) and household members of each (whether related or not) are not eligible to participate in or win the Promotion. Individuals who have won a prize (or whose household has won a prize) from Sponsor within six (6) months prior to the Start Date of this Sweepstakes are not eligible to participate or win. “Household” members shall mean people who share the same residence at least three (3) months a year. By participating, entrants agree to these Official Rules and the decisions of the Sponsor.

HOW TO ENTER: There are two (2) ways to enter this Sweepstakes. Limit of one (1) entry per person and two (2) entries per household per method of entry. Entries submitted or completed by anyone other than the entrant are void. Sponsor will not verify to entrants the receipt of all entries. Entries made using an automated entry device of any kind will be automatically disqualified without notice. Eligible entries must be received by the close of the Promotion Period.

Entry Method 1: Web Entry Visit www.liptonhardtea.com/groundhogday, provide the information requested on the entry form, and submit. In case of multiple entries from any one person or e-mail address, only the first entry will be accepted. Entries will be deemed made by the authorized account holder of the email address used at the time of entry. The “authorized account holder of the email address” is defined as the natural person who is assigned to the email address used to enter the Sweepstakes by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the email address used to enter the Sweepstakes.

Entry Method 2: QR Code On your smart phone, scan the QR Code located on participating Sweepstakes displays, complete the entry form by providing all information requested, and submit. QR Code reader software is required, and messaging/data charges may be assessed by your mobile phone service provider. Check your phone plan for details. There is a limit of one entry per person. In case of multiple entries from any one person or mobile phone number, only the first entry will be accepted. Entries will be deemed made by the authorized account holder for the mobile phone number used at the time of entry. The “authorized account holder of the mobile phone number” is defined as the natural person who is assigned to the mobile phone number used to enter the Sweepstakes by the mobile phone service access provider associated with the mobile phone number used to enter the Sweepstakes. Incomplete entries will not be acknowledged, accepted, or returned. Entries made by automated entry devices will be disqualified.

PRIZES AND DRAWINGS: On or around 02/15/2025 and subject to confirmation of eligibility, one (1) winner (“Winner”) will be randomly selected from all eligible entries received. Winner will be notified by phone, text-message, or email and hereby consents to receiving such phone call, text-message, or email by entering this Sweepstakes. The prize (“Prize”) includes:

Up to $5,000 for Winner and one (1) guest (“Guest”) to use towards travel and accommodations at a destination of your choice. Travel and accommodation will be booked by Sponsor’s travel agency and travel must be booked within 10 weeks of Winner being notified of winning or Winner forfeits the Prize. When working with Travel Agency, trip must be booked at least 45 days out.

Exact specifications of prize to be determined in collaboration with Sponsor and Sponsor’s travel agency and may vary from as described above based on availability. The approximate total retail value (“ARV”) of the Prize is $5,000.00. Other restrictions apply. The odds of winning a Prize will depend on the number of eligible entries received during the Promotion Period. Prize will be awarded unless Sponsor cannot obtain documentation from a potential Winner to prove age and residency, in which case Prize may not be awarded. Winner is responsible for all costs and expenses if travel and accommodations are over the $5,000 max value and for any costs and expenses not specifically stated as being included herein including, but not limited to, travel, passport fees, fees, additional services, upgrades, personal expenses, fees associated with travel documents, parking, tolls, gratuities, transportation, excursions, tips food, insurance, all taxes, surcharges, registration fees, and all other costs and expenses incurred in claiming, registering, or using the Prize. Winner and Guest must follow, and their use/receipt of the Prize is subject to, all Sponsor, airport, airline, and/or hotel, requirements and safety protocols. Sponsor will not be responsible in the event that the Winner and/or Guest is denied entry to a portion of the Prize for any reason, including for failure to comply with any applicable Sponsor, airport, airline, and/or hotel rules or safety protocols. Flight and accommodations are subject to, among other things, delay, postponement, rescheduling and cancellation. Sponsor is not responsible for delayed, postponed or cancelation for any reason. In the event of postponement, rescheduling or cancellation, the Winner will be notified by Sponsor, who may substitute the Prize for a prize of equal or greater value or with a company check in the amount of the ARV for the Prize, to be determined at Sponsor’s sole discretion. Winner assumes all responsibility for Winner and Guest in the course of receiving and using the Prize. No alcohol is being awarded as a Prize.

CONDITIONS: Winner and Guest must be 21 years of age or older at time of entry. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. In the event there is any difference between the actual value of the Prize and the ARV, no refund for any difference will be provided. If the actual value of the prize is less than the stated ARV, Winner is not entitled to the value of the difference. The Prize will be awarded unless Sponsor does not receive required documents in a timely manner in which case the Prize may not be awarded. All expenses and costs associated with the acceptance or use of the Prize that are not expressly specified in these Official Rules as being part of the Prize are the sole responsibility of the Winner. By accepting the Prize, (i) Winners hereby accept any and all risks associated in using the Prize and (ii) Winners hereby indemnify Sponsor for any injuries, including death, obtained in connection with using the Prize. If Sponsor is unable to make contact with or receive personal confirmation from a Winner of being selected as a Winner within three (3) days from the first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected. The acceptance or use of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. If Sponsor should request any additional information from Winner in connection with but not limited to proving Winner’s eligibility status, Winner with have one (1) day from the date of that request to provide the information and/or documentation requested. Should Winner fail to provide the requested information/documentation or book the trip within the specified timeframe, Prize will be forfeited, Winner will be disqualified and Sponsor reserves the right to select an alternate Winner. Acceptance of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media in perpetuity, without notice or further compensation. Winner, and Winner’s Guest, if any, will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within three (3) days from the date of receipt. Sponsor will issue an IRS Form 1099 for prizes valued in excess of $600.00. All federal, state, and other taxes are the responsibility of each Winner. Sponsor does not provide tax advice. No substitutions are allowed and the Prize may not be transferred, conveyed or auctioned. All Prizes will be awarded unless Sponsor does not receive required documents in a timely manner in which case all Prizes may not be awarded. Winners agree to release, discharge, indemnify, and hold harmless the Sponsor, their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Sweepstakes. External links may be subject to additional terms and conditions. Sponsor is not liable for any material, terms, conditions, or any other losses or damages as a result of visiting the external site. ENTRANT WARRANTY AND RELEASE Each entrant warrants that he/she is eligible to participate in this Sweepstakes and has the legal capacity to agree to the terms of these Official Rules. By accepting a prize, each Winner agrees to release the Released Parties from any and all liability, losses, or damages arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity. With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. Void wherever prohibited or restricted by law.

LIMITATIONS ON LIABILITY: Sponsor and its agents and their respective officers, directors, and employees are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for any electronic, network, or computer, or phone failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed transmissions that may limit a user’s ability to participate in this Sweepstakes, or for any other hardware, software, or technical errors of any kind including any injury or damage to any person’s electronic equipment related to or resulting from participating in the Sweepstakes, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, phone, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, or with respect to any Sweepstakes-related materials. All entries become the property of the Sponsor. Headings are provided for convenience only. Sponsor is not responsible or liable for any loss, damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, air and ground transportation carriers, and any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, sickness, injury, or Acts of God. Winner agrees to indemnify, and hold harmless the Sponsor and its parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses incurred by the Winner, or caused by the Winner, (including death) resulting in whole or in part from attendance at any Prize-related event, use of the Prize, misuse of the Prize, or participation in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes once mailed. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes, or award the Prize through a random drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause. Sponsor makes no warranty as to the merchantability or fitness for a particular purpose of the Prize awarded. Pictures used are for illustrative purposes only and actual Prize may differ. DISPUTE RESOLUTION: Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in State or Federal court located in Monroe County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental, and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT THEY MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
